Darlington man sentenced to 6 years for Shoplifting
Michael Cherry, age 50 of Darlington, SC, pled guilty to Shoplifting on Wednesday, March 19, 2025 just before his trial was scheduled to begin in Darlington County General Sessions Court. The charge stemmed from a September 2, 2024 incident where Cherry stole from the Circle K in Darlington, SC. Judge Brian Gibbons sentenced the defendant to 6 years incarceration. The case was prosecuted by Assistant Solicitor Savannah Baxley.
After seating a jury, the defendant elected to enter a guilty plea without any sentencing recommendation from the prosecution. Shoplifting carries a maximum sentence of 10 years incarceration. During the plea, the state presented information that Cherry entered the store and concealed numerous items of merchandise in his pants totaling $131.00. The act was captured on video surveillance. Cherry has 15 prior convictions for Shoplifting.
“Michael Cherry is a chronic problem for retailers in Darlington County,” said Assistant Solicitor Baxley. “Incarceration is the only answer when someone with a criminal record like his won’t stop stealing.”
After the plea, Solicitor Mike Burch thanked law enforcement for their investigation and assistance with the trial preparation. “Darlington PD’s actions assistance in this prosecution allowed us to get a repeat offender off the streets,” said Burch. “While we might not be able to alter Cherry’s criminal behavior, we know he won’t be a burden for Darlington for years to come.”
Cherry’s sentence will be served in a facility to be determined by the South Carolina Department of Corrections.
